Minnesota "Right-to-Work" Proposed Constitutional Amendment
“Right-to-work” or “freedom of employment” proposals to amend the Minnesota Constitution have been introduced in the current session (HF 65, HF 2140/SF 1705, and SF 1714). Although the language may change, if the effort succeeds voters will be asked: "Shall the Minnesota Constitution be amended to guarantee all citizens the individual freedom to decide to join or not join a labor union, and to pay or not pay dues to a labor union?”
The Library has collected a variety of reports that provide pro and con viewpoints on this issue, including:
- Does 'Right-to-Work' Create Jobs?: Answers from Oklahoma, by the Economic Policy Institute. They state: “Misleadingly named right-to-work (RTW) laws do not, as some unfamiliar with the term may assume, entail any guarantee of employment for those ready and willing to work. Rather, they make it illegal for a group of unionized workers to negotiate a contract that requires each employee who enjoys the benefit of the contract to pay his or her share of the costs of negotiating and policing it.”
- Right-to-Work and Indiana’s Economic Future, written for the Indiana Chamber of Commerce by the same people who wrote the report for the Center of the American Experiment. They postulate: “States with RTW laws have generally been more prosperous and have had higher rates of economic growth. Moreover, people have moved in large numbers to RTW states, signaling that many perceive that these states offer a higher quality of life.”
- "Right to Work" vs. the Rights of Workers, a report from the Higgins Labor Studies Program, University of Notre Dame. They say: “The battle over RTW legislation is a continuation of the campaign against workers and unions that has been waged in this country for the past thirty years. That campaign has led to stagnating wage levels and deteriorating conditions for workers.”
