Minnesota’s Olmstead Plan
The 1999 United States Supreme Court decision, Olmstead v. L. C., 527 U.S. 581 (1999) , requires states to provide community-based
services to persons with disabilities when appropriate and eliminate
unnecessary institutional placement.
United States District Court for the District
of Minnesota case, Jensen
et al v. Minnesota Department of Human Services, et al. Court File No. 09-cv-1775 , Minnesota entered into a settlement
agreement requiring the development of its own Olmstead Plan.
In
2012, Minnesota’s Olmstead Planning Committee was formed and in January 2013,
Governor Dayton issued Executive Order 13-01 establishing
the Olmstead Sub-Cabinet to "promptly develop and
implement a comprehensive Minnesota Olmstead Plan."
The
Minnesota Olmstead Sub-Cabinet is actively
working to develop the current draft and to develop specific plans on topics
such as employment, housing and transportation. The first draft
(or read the overview)
of the plan, Putting Olmstead’s Promise into Practice: Minnesota’s Olmstead
Plan was released in June. A second draft
of the plan was released this September.
As
Minnesota moves forward with implementation, the Legislative Reference Library will
continue to acquire relevant reports related to the Minnesota
Olmstead Plan.
