A STATEMENT FROM THE GOVERNOR'S DIRECTOR OF COMMUNICATIONS -- January 12, 2010
 

The six documents below were filed today with the Clerk of Appellate Courts and Ramsey County District Court.

The documents:

1. Reflect our formal appeal from Judge Gearin’s unallotment ruling in the Brayton case.
2. Ask the Minnesota Supreme Court to take immediate and expedited review of this matter.
3. Alternatively ask the Minnesota Court of Appeals to handle the appeal in an expedited fashion if the Minnesota Supreme Court declines to take immediate review of the appeal.

As reflected in our papers, the plaintiffs (respondents) agree that the Minnesota Supreme Court should grant accelerated review of this appeal.

Here is a comment you can attribute to me as Governor Pawlenty’s spokesman:

More than 70 years ago the legislature granted Minnesota governors the authority to unallot and the district court’s decision misinterpreted that law in key respects. We hope the Minnesota Supreme Court will more clearly and directly address this issue.
