Mandate Details

Description: Report including data collected on: (1) the total number of competency examinations ordered in each judicial district separated by county; (2) the age, race, and number of defendants for whom at least one competency examination was ordered in each judicial district, separated by county; (3) the age, race, and number of defendants found incompetent at least once in each judicial district separated by county; and (4) all available data on the level of charge and adjudication of cases with a defendant found incompetent and whether a forensic navigator was assigned to the case. The report may also include recommendations for statutory or funding changes related to competency attainment.

Note: The State Competency Restoration Board is within the Judicial Branch and is not under the administrative authority of the Supreme Court. Therefore, the Judicial Branch is not involved in the Board's operations. This relationship mirrors the relationship the Judicial Branch has with the public defender system and the guardian ad litem system. Funding for the State Competency Restoration Board begins July 1, 2023.
